Terms of Use and Terms of Sale

These terms govern the use of https://ideamakerbusiness.bob-the-worker.com (the “Service”), operated by ideamaker (the “Publisher”). Creating an account means accepting them.

The Publisher:

1. The Service

The Service provides tools to explore and validate business ideas, including an AI assistant, a discussion forum, an email workspace and content pages. It is provided as it stands, and features may evolve.

2. Your account

You must be at least 15 years old. You give an accurate email address, keep your credentials confidential, and remain responsible for what happens under your account. One person, one account.

3. Acceptable use

You may not use the Service to publish unlawful, defamatory, hateful or infringing content, to harass anyone, to attempt to break its security, to scrape it in bulk, or to resell access to it. The Publisher may remove content and suspend an account that breaches this article.

4. Your content

You keep the ownership of what you write. You grant the Publisher the technical licence needed to store, display and process it in order to operate the Service (including sending it to the AI features you invoke). The Service itself, its code, its design and its trademarks remain the property of the Publisher.

5. AI features

Answers, summaries and labels are produced by a language model. They can be wrong. They are not professional, legal, accounting or financial advice, and no decision should rest on them alone.

6. Subscription, price, payment

The subscription tiers, what each one includes and their prices (in euros, VAT included) are shown on the pricing page before any purchase. The price displayed there is the price charged.

• You choose a tier and a billing period, and the subscription is charged for that period.
• The purchase box carries one acknowledgement: you accept these terms and you expressly ask for the Service to start as soon as the payment goes through (Consumer Code, Art. L.221-25).
• The subscription renews automatically at the end of each period, at the price then displayed, until you cancel.
• A change of price is announced to you before the renewal it applies to, in time for you to cancel first under article 7.
• Payment is handled by our payment provider. Card details are never transmitted to the Publisher and never stored by it.
• The invoice for each payment is available from the billing history in your account, and a confirmation of what you accepted is sent to you by e-mail.
• No box is pre-ticked, and renewal is stated to you before you pay.

7. Cancellation

You cancel from your account, in three steps: open your profile, open the subscription section, confirm the cancellation (Consumer Code, Art. L.215-1-1).

• The cancellation takes effect at the end of the paid period in progress. You keep the full use of the Service until then, and you are not charged again.
• No reason is required and no penalty applies.
• You may reactivate the subscription from the same page for as long as the period in progress has not ended; it then continues as before.
• A cancellation is not a refund. A refund inside the first 14 days is the withdrawal of article 8.

8. Right of withdrawal (14 days)

The Service is a digital service supplied online. As a consumer you have 14 days from the day you subscribe to withdraw, without giving a reason and without penalty (Consumer Code, Art. L.221-18).

• You withdraw from your account, in the subscription section, in the same three steps as a cancellation. A written request sent to contact@bob-the-worker.com is accepted as well.
• The refund is total: the whole amount paid for the period in progress is returned to you, by the same means of payment, within 14 days of your request (Consumer Code, Art. L.221-24).
• Nothing is deducted for the days already used, although the law would allow it.
• Access ends as soon as the withdrawal is recorded: the withdrawal ends the contract whose immediate performance you asked for at checkout (Consumer Code, Art. L.221-25).
• The confirmation of your purchase, and the confirmation of your withdrawal, are sent to you by e-mail on a durable medium (Consumer Code, Art. L.221-13).
• After those 14 days the same request is a cancellation, handled under article 7.
• The 14 days run from the first subscription only. A renewal opens no new withdrawal period, because it continues a contract already concluded.

8b. Goods sold in the shop

Goods bought in the shop are sold under these terms, with the return right the law gives a distance buyer of goods.

• You have 14 days from the day you receive the goods to change your mind, without giving a reason (Consumer Code, Art. L.221-18).
• You ask for the return from My orders in your account, or in writing to contact@bob-the-worker.com.
• You then send the goods back within 14 days of your request, complete and in a condition that allows them to be sold again.
• Return shipping is at your expense, unless the goods arrived damaged, incomplete or not as described, in which case the Publisher pays it.
• The refund covers the price of the goods and the standard delivery charged to you, by the same means of payment, within 14 days of the Publisher receiving the goods back (Consumer Code, Art. L.221-24).
• The law excludes some goods from this right (Consumer Code, Art. L.221-28):
  • goods made to your specifications or clearly personalised;
  • goods liable to deteriorate or to expire quickly;
  • sealed goods unsealed after delivery that cannot be returned for reasons of hygiene or health protection;
  • goods inseparably mixed with other items after delivery;
  • sealed audio or video recordings and sealed software, unsealed after delivery;
  • newspapers, periodicals and magazines, outside a subscription.

9. Availability and liability

The Publisher takes reasonable care to keep the Service available but does not guarantee uninterrupted operation. The Publisher is not liable for indirect damage, loss of profit, loss of data caused by your own use, or business interruption. Nothing in these terms excludes liability that the law does not allow to be excluded.

10. Suspension and termination

The Publisher may suspend or close an account that breaches these terms, after notice where the breach allows it. You may close your account at any time; closure deletes your data as described in the Privacy Policy.

11. Personal data

Processing of personal data is described in the Privacy Policy, and the browser storage in the Cookie Policy. Both form part of your relationship with the Publisher.

12. Changes to these terms

A change is published as a new version. You are asked to accept the new version before continuing to use the Service. The version you accepted, and the exact text of it, is kept so that it can be shown to you later.

13. Mediation, applicable law, jurisdiction

Applicable law

These terms are governed by French law. Failing an amicable settlement, the dispute is brought before the competent French courts.

14. Severability

If a clause of these terms is held invalid, the remaining clauses stay in force.
